Hold placed On Charloe Musu’s Murder Trial Again

Following the suspension of Solicitor General Cllr. Nyenati Tuan on hearing Charloe Musu’s Murder Trial involving former Chief Justice Gloria Musu Scott and three others, Justice- In- Chamber Jamesetta Wolokollie has issued a stay on the trial.
This come after the defense lawyers filed a writ of certiorari against Criminal Court ‘A’ Judge Roosevelt Z. Willie’s  decision on the allegations of Cllr. Tuan secretly entering the premise of Temple of Justice where the Jurors in the case are situated under sequestration at 8:00 P.M.
Cllr. Scott lawyers contended that Judge Willie should review and correct the erroneous and prejudicial ruling by Judge Willie for refusing to suspend the trial and conduct a full scale investigation on allegations of Jury tampering by Solicitor General  Tuah
They furthered that on September 13, 2023, Solicitor General Tuah visited the Temple of Justice at about 9:30 p.m. and ordered the judicial security in person of Marcus Cleon to open the gate of the Temple of Justice but the judicial security officer assigned refused. Interestingly, Cllr. Tuan forcefully gained entry to the compound and proceeded to the petit jurors while being sworn sequestered.
Cllr. Scott said Cllr. Tuah presence is believed to have had discussions and even extended financial consideration to the trial jurors with the hope of jurors' returning verdict in favor of the Government of Liberia(GoL) in these proceedings.
That further it is worthy to note that all of these unwarranted and illegal and arbitrary actions on the part of the Solicitor- General   Tuan was being carried out in the presence of judicial security officers assigned at the basement where the jurors have been sequestrated.
After preliminary investigation was done by the Chief Marshall at the Temple of Justice and got the attention of Judge Willie through the Jury Management, Judge Willie suspended the  trial and had a conference with both lawyers. At that meeting, Cllr. Tuan admitted being prevented at the premise but at about 5: 30 -6:00 P.M, not 9:00 PM. He explained that he met with the Judiciary Security Services at the gate and they escorted him to interact with his officers assigned at Jury Quarter. He clarified that he did not interact wit or interfere with any of the jurors, adding that he did not want the reoccurrence of what happened in the US$100,000,000.00 drug case happens in said case.
When that was said by Cllr. Tuan of his alleged action, which seems to impair the dignity and independence of administration of justice. Sadly,  without a full-scale investigation but a mere factual admission of Solicitor-General  Tuan to the effect that he went to the premises of Temple of Justice without court approval neither was with the knowledge of Defense Attorneys, Judge Willie mere suspension and imposition of fine, which is far inadequate and insufficient given the gravity of his conduct of jury tampering especially so when criminal defendants are languishing behind bar living in the catatonic urines and human menu.
He emphasized that Judge Willie erred in law and also in procedural proceedings when he acknowledged the arbitrary and illegal conduct of the Solicitor-General when he gained access to the premises where the jurors are sequestrated and suspended him from ever participating in the trial of the said case, imposed a fine of United States Dollars Two Hundred Fifty (US$250.00) without a full-scale investigation into the matter.
In addressing this matter, Justice- In- Chamber Wolokollie placed a stay order pending a resolution of the writ of certiorari. Meaning that the case will not be heard till Associate Justice review Judge Willie decision.
By directive of Her Honor Jamesetta H. Wolokolie, Associate Justice presiding in Chambers, ‘‘you are hereby cited to a conference with Her Honor on Monday, September 25, 2023, at the hour of 1:00 p.m.  in connection with the above captioned case.’’
Cllr. Scott, who served as Chief Justice of Liberia, Justice Minister and Sentor of Maryland County, Gertrude Newton, Alice Johnson and Rebecca Wisner, are undergoing trial for the crimes of murder, criminal conspiracy and making false statements to law enforcement officers.
